Terms & Conditions

By using the services of Essence of Elegance Travel, LLC, and its independent travel advisors (collectively “we”, “us”, “Essence of Elegance Travel” or “Travel Advisor”), the Client (“you” or “Traveler”) is signifying your agreement with the following terms and conditions (“Terms”, “Agreement”), on behalf of yourself and all members of your traveling party.

1.  AGENT FOR SUPPLIERS

Travel Advisor is not the source or supplier of the travel services requested and acts solely as a travel agent on behalf of numerous transport and accommodation service providers, including, but not limited to, tour companies, cruise line operators, hotels, airlines, ground transportation and other companies providing accommodations, transportations, and/or other services (“Suppliers”) named in your itinerary or confirmation. Each of these Suppliers is an independent entity with its own management. Essence of Elegance Travel does not own, operate, manage or control these independent Suppliers and is not responsible or liable for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard.  Requests cannot be guaranteed.  All bookings are subject to the terms and conditions and limitations of liability imposed by those Suppliers.  You acknowledge that your travel plans may be interrupted or cancelled by the Supplier, a government entity, or other third party over which we have no control. You further acknowledge that the Supplier's own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern your rights and remedies, including your right to receive a refund. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.  You understand that your legal recourse is against the specific provided, not Essence of Elegance Travel.

2. LIMITED LIABILITY

Essence of Elegance Travel is not liable for any negligent or willful act or failure to act of any travel service provider or any third party.  In addition and without limitation, Essence of Elegance Travel is not responsible for, and shall not be liable for, any accident, injury, property damage or personal loss, death, inconvenience, or delay to Traveler or to those traveling with Traveler in connection with any travel services we have booked, whether resulting from, but not limited to, acts of God or force majeure, illness, disease, weather conditions, natural disasters, acts of governments or other authorities, wars, civil disturbances, riots, strikes or other labor activities, epidemics, acts of terrorism or criminal activities, breakdown in equipment, theft, delay, fuel increases or cancelation, animals, or any other unforeseeable event. Travel Advisor is not responsible for missed connections, schedule changes, aircraft changes, overbooking or downgrading of accommodations, disappointment, or trip interruption. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements.  You specifically agree that Essence of Elegance Travel is not liable for any consequential loss or damage.

We may book wellness travel for clients, which may include yoga, meditation, medi-spa, and other activities, treatments and services intended to maintain, manage, or improve travelers’ health and well-being (“Activity” or “Activities”). We have no specialized knowledge of the practices or techniques employed by our Suppliers, and make no representations of the qualifications of the professionals and practitioners who offer these Activities. We make no representations that by participating in these Activities there will be any demonstrable improvement in your physical, mental, emotional, or spiritual well-being. We are not responsible if your participation in these activities leads to a worsening of any condition you may have. We are not responsible for any injuries you may sustain, illnesses you may contract, including injuries or illnesses that may result in loss of life. You acknowledge that you are voluntarily participating in the Activities on your itinerary, and that you understand that there are risks associated with your participation in the Activities, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from your own or other’s actions, inactions, or negligence, or the condition of the Activity location(s) or facility(ies). Nonetheless, you assume all risks of your participation in the Activity, whether known or unknown to you, including travel to and from the Activity (including air travel) or any events incidental to the Activity.

3.  RISKS OF TRAVEL

Travel Advisor assumes no responsibility for, and shall not be liable for, the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, lack of access to medical facilities, inadequate road or other infrastructure conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website.[1] For medical and health information, we recommend going to the Centers for Disease Control website.[2] Each Traveler is responsible for making certain that they have proper immunizations before travel. For destination information specific to COVID-19, we recommend visiting IATA's COVID-tracking site[3] in addition to the State Department site.

It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions. ULTIMATELY, IT IS YOUR RESPONSIBILITY TO UNDERSATND AND ABIDE BY ALL REQUIREMENTS AND RESTRICTIONS WHEN TRAVELING. This may include the following: health affidavit forms; health screenings prior to departure and/or upon arrival; temperature screenings prior to departure and/or upon arrival; travel reason affidavit forms; online travel authorizations; airline safety & health requirements, such as health forms, screenings, face coverings; in-country requirements, such as periodic temperature checks, quarantine, face coverings; visas. Failure to meet the requirements and/or restrictions puts you at risk for fines, quarantine or deportation at your expense.

BY ACCEPTING THIS AGREEMENT, THE TRAVELER UNDERSTANDS AND VOLUNTARILY ASSUMES THE RISK, BOTH KNOWN AND UNKNOWN, ASSOCIATED WITH THE TRIP OR ACTIVITIY.

 

4.  TRAVEL DOCUMENTS

Traveler is responsible for reviewing your documents when received by Travel Advisor.  You agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. Any errors in names, dates, and timings on your documentation will be your responsibility if we are not advised at the time of booking. The names on your documents must match your government-issued ID.  Travelers will receive their travel vouchers through email or through the postal service, depending on the trip type.  Trips booked within 30 days of departure may be limited to email documents only.

It is the Traveler’s responsibility to have proper travel documents for all trips including, but not limited to, vouchers, passports, visas, marriage licenses, or birth certificates. Travel insurance should be purchased to protect you in these circumstances. Change and cancel fees may apply at the time of a change or cancellation of existing schedule if correct travel documents are not available, and are the sole responsibility of the Traveler.

5. FLIGHT CHECK-IN

Travel Advisor recommends that you check in a minimum of two (2) hours prior to scheduled departure for domestic flights and three (3) hours prior to scheduled departure for international flights. Recommended check-in times are subject to change without notification. Traveler is responsible for remaining abreast of changes in condition or airport rules that might require earlier arrival times. It is Traveler’s responsibility to reconfirm flight times with the carrier at least 24-72 hours prior to scheduled flights. Travel Advisor does not assume responsibility for any air or schedule changes. Failure to arrive within your airline's specified time could result in denial to board.

6. PROOF OF IDENTITY

Travelers must present an accepted photo identification such as a passport or other state or government-issued photo. IMPORTANT INFORMATION FOR DOMESTIC AIR TRAVELERS: The Federal Real ID Act mandates stricter security standards for state-issued driver’s licenses and other forms of identification and prohibits Federal agencies from accepting for official purposes identification that does not meet these standards.  Beginning on May 7, 2025, every air traveler will need to present Real ID-compliant identification to be permitted to board a domestic flight; therefore, those holding a non-compliant driver’s license will need to present an acceptable alternate form of identification, such as a valid U.S. passport.  To avoid disruption to their travel plans, air travelers are strongly encouraged to consult with the Department of Homeland Security[4] to determine whether their state-issued identification is Real ID-compliant and, if not, what alternate forms of identification will be accepted at the airport.  Please refer to the Transportation Security Administration (TSA) website[5] to find the latest information on required documents.

7.  PASSPORTS AND VISAS

All individuals departing from the United States of America must be in possession of a valid passport. International destinations may have additional requirements such as a visa that you must obtain prior to departure. If you are a non­-US citizen, different immigration requirements apply. Traveler is responsible for contacting the applicable consulate(s) to determine what documents are required. Without proper identification, or passport and necessary visas, you will not be permitted to depart.

Traveler assumes full and complete responsibility for checking and verifying that you have valid travel documentation including but not limited to passport, visa, vaccination, or other entry requirements of your destination and your connecting points which meet the requirements of immigration and other government authorities at every destination. Many countries require your passport to be valid for six months or more AFTER your date of return. You are responsible for confirming with the United States Department of State or the representative government agency of the country to which you are traveling to confirm the requirements for visas and/or other requirements for admission to your destination. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.

8. TIMES, FLIGHTS AND FARES

Times, flights, and fares are based on current tariffs that are subject to change without notice.  Most discount fares involve certain restrictions. A change in carrier(s) flight(s), time(s) or routing(s) could result in a carrier demanding a full fare which is the sole responsibility of the Traveler.

9. PRICE INCREASES

Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the Supplier and/or government, even after you have completed your purchase. Traveler expressly acknowledge your acceptance of these conditions (i.e., increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and Traveler may be bound by those contracts regardless of whether you receive notice of their terms.

10. TRAVEL ADVISOR FEES

Traveler agrees to pay the travel planning, change, and other fees included in Travel Advisor’s Planning Fee Schedule. All fees are non-refundable.

11.  DEPARTMENT OF TRANSPORTATION REGULATIONS

As of February 06, 2012, the United States Department of Transportation (DOT) regulations require that we post the following to our Terms & Conditions for vacation packages that include airfare:

​

Please be aware of:

  1. Fees and taxes that you may be charged during your trip that are not included in the vacation package price given;

  2. Any hotel taxes that will be charged upon check-in or check-out (e.g. local city hotel tax);

  3. Baggage fees for airfare;

  4. Taxes for airfare (changes in taxes after you have purchased your ticket); and/or

  5. Other fees for airfare not included in your initial vacation package purchase.

 

Essence of Elegance Travel make every effort to honor the package price quoted originally, however; under certain circumstances your price may be subject to increase prior to full payment due to an increase in the cost for one or more of the travel components of your package. By booking through Essence of Elegance Travel, you expressly acknowledge your acceptance of these conditions applicable to your purchase.

12. TOUR, CRUISE AND PACKAGE PRICES

Tour, cruise and package prices are subject to change without notice due to currency fluctuations, tariff changes or increase in operational costs. In addition, group tours/packages are based on a minimum number of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed on all passengers.  Traveler is responsible for the difference of a change of price.

13. FOREIGN FEES

Traveler is responsible for ascertaining any foreign transaction fees on your debit or credit cards.  The Travel Advisor is not responsible for any foreign transaction fees occurred when making payments to vendors located overseas. Certain countries require departure taxes that require payment in cash.

Quotes given in foreign currency will have an estimate of the United States Dollar (USD) equivalent which will be accurate on the day of the quote. The prices are based on the rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice.  Travel Advisor is not responsible for any fluctuations in the exchange rate between quoting and charging the transaction.

14. FINAL PAYMENT

Traveler is responsible for noting the final payment dates and plan accordingly.  Travel Advisor will make every effort to contact the Traveler with reminders; however, Travel Advisor is not responsible for missed payment dates when Traveler is unresponsive.  Any cancellation, and subsequent cancellation fee, that results from the Travelers’ missing final payment are the Travelers’ responsibility and reinstatement may result in additional costs to the Traveler.

15. OVERBOOKING

Airline flights may be overbooked. A traveler denied boarding on a flight may be entitled to a compensatory payment. The rules for denied boarding compensation are available at all ticket counters.  If you are denied boarding, Travel Advisor is not responsible for reimbursement of any costs due to hotel stays, meals or other costs incurred while waiting for the next booked flight, or for compensatory payment by the airline.

16. RESERVATION RULE VIOLATIONS

Traveler agrees not to purchase a ticket or tickets containing flight segments that you will not be using, such as a "point-beyond", "hidden-city", or "back-to-back tickets". You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel. You acknowledge that the airlines generally prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets. If you do not use one of the flights in your reservation, the airline will cancel your remaining itinerary, and it may confiscate your frequent flyer points. You agree to indemnify Travel Advisor against airline claims for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

Supplier reserves the right to refuse service to travelers at their sole discretion, including, without limitation, if the Traveler: (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs, or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior.  Essence of Elegance Travel assumes no liability for the acts of the Supplier in refusing service.

17. GROUP BOOKINGS

When travelers do not live at the same address, the Travel Advisor will correspond with the initial group leader (Traveler who made the first contact) throughout the quote process. The group leader will be responsible for communicating the details of the quote and/or any Travel Advisor questions to the rest of the group. The Travel Advisor is not responsible for any dissatisfaction with the itinerary by group members: the group leader/Traveler accepts responsibility for confirming the itinerary with group members.  By agreeing to move forward with the deposits, the Traveler acknowledges that all parties have been informed of necessary details.  All quotes assume that Travelers will arrive at destinations together.  If Travelers arrive separately on different flights, they will be responsible for the additional cost of airport transfers.

18. RESPONSIBILITY TO COMMUNICATE

The Travel Advisor is not liable for any errors or omis​​sions arising from Travelers’ significant delay in responding to requests for necessary information including, but not limited to, airline schedule needed to book appropriate transfers, payment deadlines, customized suggestions for excursions or inquiries if services are needed​. The Travel Advisor reserves the right to decline to book optional services when information is not received in a timely manner.

19.  INSECTICIDE NOTICE

All Travelers are advised to always check the list of countries on the DOT’s website that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft, as the list is updated from time to time.[6]

​

20. LIMITATION FOR CONCIERGE AND OPTIONAL SERVICES

The Travel Advisor is not liable/responsible for any reservations the Traveler has made directly with the resort/hotel/tour company/ship, such as: dining reservations, concierge requests, upgraded rooms/airline seats, independently booked tours, private guides, and so on. In certain circumstances, the Travel Advisor may assist with restaurant recommendations and/or limited reservations for special events. In the event that the Traveler cannot attend these events once their trip has begun, the Traveler is responsible for contacting the in­-country partner to cancel or change the reservation themselves. The Travel Advisor is not liable for any cancellation fees or delay in processing changes/cancellations.

21. GRATUITIES AND ADDITIONAL FEES

Wherever possible, the Travel Advisor will attempt to inform the Traveler of any additional costs such as hotel taxes payable upon check in or resort fees.  Hotel taxes may appear on travel vouchers at time of confirmation and are not always shown during the initial quote. The Travel Advisor is not responsible for any omissions of additional fees during the quote process.  These types of fees include, but are not limited to,

  • Gratuities to guides, hotel staff, or drivers 

  • Mandatory onboard service charges/gratuities for cruises 

  • City taxes payable directly at the hotel

  • Costs for transport to/from the airport if Traveler did not include transfers in quote 

  • Breakfasts or other meals at hotels unless they are specifically included in quote 

 

22. CANCELLATIONS AND REFUNDS

Travel Advisor reserves the right to charge processing fees in the event of refunds, cancellations, and other services. To change or cancel your flight itinerary, Traveler must do so prior to an originally scheduled departure and may be subject to applicable airline fees. No value remains after departure. Cancellations of Supplier reservations that are guaranteed are subject to the Supplier’s cancellation policy.  Travel Advisor is not responsible for reimbursement to Traveler for any loss you incur due to your failure to travel or your failure to follow the change or cancel policies of any Supplier.

The Traveler agrees that the term “non-refundable” in any quote, booking, or invoice means that the booking cannot be refunded under any circumstance, including for reasons of pandemic, war, force majeure, or other unforeseeable events.  The Traveler waives their right to sue or institute a credit card dispute or “charge back” to Travel Advisor or its Suppliers for said penalties, fees, or real or alleged damage related to non-refundable deposits/payments or any other transaction. The Travel Advisor must be reimbursed by the Traveler for any financial penalties incurred due to credit card “chargebacks”.

23. CREDIT CARD MERCHANT

Traveler acknowledges and accepts that there are cancelation policies, change fees and penalties that apply to travel plans and services as set by Suppliers. If Travel Advisor is the merchant on your credit card transaction, our services consist of advising, facilitating the sale, collecting funds on your behalf, and remitting those funds to the Suppliers. If a Supplier does not provide the service or ceases operations, your recourse is against the Supplier, not the Essence of Elegance Travel.  Traveler agrees not to initiate a chargeback against us or a refund request that is not authorized by this Agreement and to pay any and all legal fees incurred by Travel Advisor in disputing any such claim for refund.

If for any reason credit card charges are later declined, reversed or Travel Advisor is unable to receive payment for the travel plans and services, you agree to be held liable and indemnify Essence of Elegance Travel against this chargeback from the provider, including without limitation any air debit memos charges to Essence of Elegance Travel.  If Essence of Elegance Travel incurs any costs, including but not limited to attorney’s fees to recover any payments charged back by your credit card company, you agree that you will be liable for these costs.  If the credit card is declined, you guarantee that you will settle any amounts owing to Essence of Elegance Travel via money order or cash immediately.

24. TRAVEL INSURANCE

Trip cancellation and travel insurance are strongly recommended to protect your investment.  Unless specifically noted, travel insurance is not included in the cost of the Traveler’s itinerary. If you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances of a pandemic, pre-existing medical conditions, and other policy exclusions. Note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. Consult the insurance carriers directly for details. Trip insurance or waivers provided by the Supplier may not offer insolvency coverage. No representation or description of the insurance made by Travel Advisor constitutes a binding assurance or promise about the insurance. Essence of Elegance Travel is not an insurance company and has no responsibility for the submission, payment, or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy. The Travel Advisor may add travel insurance/protection to the booking and send the Description of Coverage to the Traveler.  The Travel Advisor is not authorized to answer specific questions about coverage nor is the Travel Advisor authorized to recommend one type of travel insurance over another. It is the Traveler’s responsibility to contact the insurance provider if they wish to clarify the coverage before or after purchasing.

Traveler agrees to hold Travel Advisor harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to any claim under the policy.  A waiver may be required to refuse travel protection.

​

Note many ‘adventure destinations’ may require a minimum level of travel insurance. 

​

25. SUPPLIER BANKRUPTCIES

If an airline or other Supplier declares bankruptcy, Travel Advisor is not obligated to honor your reservation made before bankruptcy or to refund tickets issued before the bankruptcy. Travel Advisor is not allowed to refund tickets on airlines which have declared bankruptcy. Money associated with ticket payments maybe on behalf of the Traveler by the Travel Advisor immediately become the property of the airlines, and we are required by law to comply with airlines' orders. ​If an airline declares bankruptcy, the airline may continue service, limit service, or stop completely. Other airlines may accept passengers under limited circumstances or may refuse to accept any passengers from the defaulted carrier. Note there are travel insurance plans available for passengers to protect themselves in case of airline bankruptcies.

26.  SELLER OF TRAVEL

Essence of Elegance Travel, LLC is an independent affiliate of Uniglobe Travel Center which is a registered Seller of Travel (SOT) in California, CST 2055333-40, Florida, ST32940, and Washington 601809585. The Florida, Washington and California SOT laws require all sellers of travel to have a trust account or bond. Uniglobe Travel Centers, of which Essence of Elegance Travel, LLC is an independent affiliate, maintains a trust account for all client payments and deposits as required.

27. CLAIMS DEADLINE AND EXCLUSIVE JURISDICTION

The construction, validity, and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of the State of North Carolina, without giving effect to its conflict of law principles, and any federal laws applicable therein. Traveler agrees to present any claims against Travel Advisor within 30 days after your trip ends and to file suit within one year of the incident, and Traveler acknowledges that this expressly limits the applicable statute of limitations to one year.  You agree that the courts in Wake County, North Carolina will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

28.  ELECTRONIC OR HANDWRITTEN SIGNATURE

Both parties agree that you may acknowledge and agree to these Terms: (i) electronically; (ii) by handwritten signature; (iii) by any other electronic means, including, without limitation, via email acceptance of these Terms; or (iv) by your implied consent deemed via your actions, which shall include without limitation the payment of the invoice and/or your use of the services provided by Essence of Elegance Travel or any other Supplier related to your booking. All such means will be deemed to constitute effective acknowledgement and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.

29.  RESERVATION OF RIGHTS: CHANGES TO THESE TERMS AND CONDITIONS

We reserve the right, in our sole discretion and for any reason whatsoever or for no reason, to change these Terms and Conditions at any time.  Updated versions of the Terms and Conditions will be posted at www.eofetravel.com/terms-conditions and are effective immediately on posting.

SPECIAL NOTICE: COVID-19 TRAVEL

In consideration of the travel opportunity afforded to you, the Traveler and persons in Traveler’s party, acknowledges and agrees, by applying payment on travel considered herein, to the following: 

​

The 2019 Novel Coronavirus* (“COVID-19”, “Pandemic”) is a known and rapidly evolving pandemic that has affected travel worldwide, with continued spread and impacts expected. Traveler is fully aware of the current global COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved if choosing to travel. Traveler understands that it is his/her responsibility to check, understand, and comply with the latest travel information regarding this virus outbreak with the Center for Disease Control (“CDC”), domestic governing bodies, destination governing bodies, and all Suppliers associated with Traveler’s trip. Traveler is aware that it is his/her personal decision to travel and is doing so with full knowledge of current travel recommendations, restrictions, and requirements with regards to the COVID-19 and takes full responsibility for his/her actions with regards to this. Traveler understands and confirms that Travel Advisor, after reasonable inquiry, has made available to Traveler, by reference, referral, or other conveyance, the best available information known to Travel Advisor regarding pandemic policies provided by travel suppliers and governing bodies, including but not limited to airlines, hotels, cruises lines, tour agencies, insurance provider, transfer agencies or any other entity involved in Traveler’s booking. Traveler is aware of the travel warnings, travel restrictions and rules including screening and use of masks, travel insurance restrictions, and restrictions that may impede Traveler’s ability to enter or exit a destination as planned, related to COVID-19 and understands the risks, is accepting of these and holds the Travel Advisor harmless for any travel restrictions, death, illness, cancellations by Suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or destinations Traveler is traveling through. Traveler further agrees to hold the Travel Advisor harmless for any financial penalties or fees imposed by the by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider due to cancellations or postponements due to COVID-19 and agrees not to sue or institute a credit card dispute or “charge back” to Travel Advisor or its partners for said penalties, fees, or real or alleged damages.

Traveler further acknowledges that the Supplier’s own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern their rights and remedies, including their right to receive a refund, in such an event. Moreover, Traveler understands that should they elect to purchase travel insurance, the terms of the travel insurance policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances.
